Personal information is any information relating to an identifiable person.
What is personal information?
Personal information includes information that relates to:
• An individual’s personal characteristics (e.g., gender, age, home address or telephone number, ethnic background, family status);
• Health (e.g., health history, health conditions, health services received by them);
• Activities and views (e.g., opinions expressed by an individual, an opinion or evaluation of an individual).
Personal information is different from business information (e.g., an individual’s business address and telephone number). This is not protected by privacy legislation.
Who can see your health information?
Upon seeking healthcare services from us, we operate under the assumption that we have your consent to collect, utilize and share your health information with other pertinent healthcare providers within your 'circle of care'. This is strictly limited to practitioners directly involved in your healthcare; other providers are not authorized to access your information except in specific cases outlined below. If you wish to restrict use, sharing or disclosure of some or all of your personal health information to other practitioners in your 'circle of care', kindly notify us promptly.
Certain entities such as your employer or insurance company may require access to specific portions of your healthcare information. However, we will not disclose this information to them without explicit written consent. Additionally, you may designate specific family members or friends to whom you'd like us to provide detailed updates about your health, treatment progress, or required care at home. We require your consent to proceed if you wish to permit us to share your health details with family or friends.
When is consent not required?
We may use or disclose some of your personal health information without seeking consent in the following circumstances, as allowed by law or when required.
• To obtain payment for services or goods provided. Payment may be obtained from the individual, WSIB, private insurers or others
• To report certain information, such as to report certain diseases to public health authorities
• When we suspect certain types of abuse
• To reduce a significant risk of serious bodily harm to a person or the public
• For risk management and legal purposes
• To assess a person’s ability to make health care and other important decisions
• For administration or enforcement of laws related to the practices of health care providers by a Regulatory Body (ie. CMTO)
• For the purpose of a legal proceeding or complying with a court order, or other legal requirement
How long do you retain personal information?
We must retain personal information for a specific duration to facilitate addressing any inquiries about the services offered and to uphold our accountability to regulatory bodies. In compliance with CMTO guidelines, client records are kept for 10 years after the last contact. To maintain security, physical client files are securely shredded, while electronic records are permanently deleted.
